The seller of the products that you can find on the site as well as the owner of the site itself is G100 SRL registered office via Fiume 11, 50123 Florence, operational headquarter in via Guido Rossa 14, 50023 Impruneta, P.I. and C.F. 06949160482, e-mail address: info@g100.it and certified e-mail: g100srl@legalmail.it.
These general conditions of sale have as their object the regulation of the purchase of products made remotely and made available, through the site lasosta.coffee in compliance with the Italian legislation referred to in Legislative Decree 206/2005 and subsequent amendments and additions.
The consumer who accesses the site to make purchases (hereinafter "customer") is required, before sending the order, to carefully read these General Conditions that are available for him and which will be available on the site at any time for the customer.
Contracts concluded with G100 SRL through the site are governed by these General Conditions in compliance with Italian law.
1. CHARACTERISTICS AND PRICES OF THE PRODUCTS
The images of the products may not be perfectly representative of their characteristics but differ in color, size, accessories represented. All support information for purchasing is to be understood as simple general information material, not referable to the real characteristics of a single product. The products are offered at the price indicated on the site on the date an order is placed.
The prices are inclusive of VAT which will be indicated in detail in the purchase invoice of the product, if issued.
The indicated price does not include transport and delivery costs which are in any case reported in the final section before sending an order and specified in the order receipt confirmation sent by e-mail to the Customer.
2. ORDER PRODUCTS
By sending the order from the site, which has the value of a contract proposal, the customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept these transcribed General and Payment Conditions.
The receipt by G100 SRL of the contract proposal is confirmed with a specific summary e-mail.
The contract stipulated between G100 SRL and the Customer must be considered concluded with the confirmation of the order by G100 SRL which takes place via the order confirmation e-mail.
3. PRICES AND SHIPPING
The prices of the Products include all taxes and duties required by law.
Prices are expressed in Euro €.
Shipping costs are calculated by the system based on weight (real and volumetric) and destination and indicated to the Customer before payment.
Any duties and customs charges will be exclusively charged to the customer.
4. METHOD OF PAYMENT
The Customer may pay the price of the Products and the related delivery costs by credit card.
The Site does not store the Customer's credit card number and therefore cannot be held responsible for any fraudulent use of the aforementioned payment instruments.
5.TRANSPORT AND DELIVERY
The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure.
All purchases will be shipped by DHL Express courier on Wednesdays, excluding holidays and national holidays. G100 SRL is not responsible for unforeseeable delays or those not attributable to it.
In any case, except in cases of force majeure or unforeseeable circumstances, the Products ordered and paid will be delivered within a period of 15 (fifteen) working days from the day following that in which G100 SRL confirmed the order to the Customer by specific e-mail confirmation and shipment of the order. The aforementioned term of 15 working days applies to shipments in Italy and abroad, with the exception of countries outside the European Union for which the term of 15 days may be increased according to the different local customs clearance times.
The conditions relating to this transport are shown on the website of the courier above, the service provider. In any case, G100 SRL reserves the right to use other couriers at any time in the event that the service offered by such couriers is more efficient or effective.
With each shipment, the customer receives the tracking of the shipment of his order to his e-mail address indicated in the order, through which he can check the status of the shipment on the website of the courier / transporter used, or through its call center.
Shipments abroad can be made with different couriers depending on the country of destination in order to ensure the customer the best available rate.
The customer undertakes to immediately contest any damage to the packaging and / or the product or the mismatch in the number of packages or indications by placing a specific indication on the delivery document. By signing the courier's document, the customer certifies the real external integrity of the product and the conformity of the delivery.
6. RIGHT OF WITHDRAWAL
The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except for the cases of exclusion explicitly provided for in the following point 4. To exercise this right, the Customer must send G100 SRL a written communication within 14 days from the date of receipt of the Products by registered mail or, if you intend to exercise the withdrawal before having received the Products, the withdrawal notice may be sent at any time prior to their receipt.
This communication must be sent by registered letter with return receipt, addressed to: G100 SRL, Via Fiume 11, 50123 Firenze; and sent in advance by e-mail to info@g100.it.
Once the communication has been received, G100 Srl will open a file for the management of the return and communicate to the Customer the instructions on how to return the Products.
The right of withdrawal is governed by the following conditions:
- The law applies to the Product purchased in its entirety; therefore if the Product is composed of several components or parts it is not possible to exercise the withdrawal only on part of the purchased Product.
- In case of exercise of the right of withdrawal, G100 Srl will refund the customer the full amount of the returned goods, excluding shipping costs where applicable, within 14 days from the date on which the notice of withdrawal was received, without prejudice to the right of G100 Srl to suspend the payment of the refund until the actual receipt of the goods. The refund will be made using the same payment method used by the Customer.
- The Products must be returned in the same box in which they were received.
- In addition to the cases of non-consumer customers and / or customers who request an invoice, the right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 21/2014:
- order of Products made or packaged to measure.
- order of Products that are likely to deteriorate or expire rapidly. The coffee purchased is expressly included among the products that risk deteriorating.
- order of sealed Products that cannot be returned for hygienic reasons or related to health protection or that have been opened after delivery.
With reference to the cases of exclusion of the withdrawal listed above, the Customer, in particular, is informed and accepts that among the Products that among the "Products made or made to measure" and / or "Products that are likely to deteriorate or expire rapidly" all include the food products offered on the site, as the characteristics and qualities of these types of products are subject to alteration also as a result of inappropriate storage. Therefore, for reasons of hygiene and customer protection, the right of withdrawal is applicable only for Products purchased on the Site of a non-food nature and which are suitable for being put back on the market without endangering the health of consumers.
7. WARRANTY AND CONFORMITY DEFECTS
In case of conformity defects of Products, other than food, sold by G100 SRL, the Customer must immediately contact G100 SRL using the appropriate e-mail address info@g100.it.
The legal guarantees provided for in articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. The Customer has the right, at his choice and provided that the type of Product allows it, to restore, without charge, the conformity of the Product by repair or replacement, or to an adequate price reduction or termination of the contract. The Customer loses these rights if he does not report the lack of conformity to G100 SRL within 15 days from the date on which he discovered the defect, provided that it is not a Product which by its nature is perishable or subject to expiry in a shorter term, in which case the defect must be reported within this reduced term.
8. ERRORS AND LIMITATIONS OF LIABILITY
The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors for which G100 SRL cannot therefore be held responsible, except in the case of willful misconduct or gross negligence.
G100 SRL reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to change or update information at any time without prior notice, without prejudice to the Customer's rights under these Conditions Generali and the Consumer Code.
Except for willful misconduct or gross negligence, any right of the Customer to compensation for damages or the recognition of compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance or evasion, even partial, of an order.
9. COMPLAINTS
Any complaint must be sent to G100 SRL by registered letter with return receipt to the following address: Via Fiume 11, 50123 Firenze,
G100 SRL undertakes to respond to all requests received within a maximum of 7 working days.
10. APPLICABLE LAW AND JURISDICTION
The sales contract between the customer is concluded in Italy and governed by Italian law. For the solution of disputes relating to the interpretation, execution or resolution of these General Conditions or of individual purchase orders if the Customer is a consumer pursuant to the Consumer Code, the court of his / her town of residence or of domicile if located in the Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the Court of Florence, any other competent court excluded.
Pursuant to Article 1341 of the Italian Civil Code the Customer declares to have read and specifically accepted the following articles of these General Conditions: (responsibility for delays in delivery) and (right to correct errors - disclaimers).
